These Terms of Use ("Terms") govern your access to and use of MarkupGen, a service that converts Figma designs into HTML, CSS and React source code. By accessing or using MarkupGen, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, installing the MarkupGen plugin, or otherwise using our services, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use MarkupGen.
2. Description of Service
MarkupGen provides a software-as-a-service platform and a companion Figma plugin that converts Figma designs into HTML, CSS and React source code. Features, output quality and available frameworks may change over time as we improve the service.
3. Eligibility & Account Registration
You must be at least 16 years old and capable of forming a binding contract to use MarkupGen. You are responsible for providing accurate registration information and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
4. Subscription Plans & Payment
Certain features require a paid subscription. Fees are billed in advance on a recurring basis according to the plan you select and are non-refundable except where required by law. We may change our pricing with reasonable prior notice; continued use after a price change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to: (a) use MarkupGen for any unlawful purpose; (b) attempt to reverse engineer, decompile or bypass usage limits of the service; (c) upload content you do not have the right to use; or (d) interfere with the security or proper functioning of the service.
6. Intellectual Property
MarkupGen and its underlying technology, branding and documentation are owned by us and protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use MarkupGen for your own projects.
7. Your Content & Figma Data
You retain all rights to the Figma designs and content you import into MarkupGen. We only access the frames you explicitly import in order to generate code, and we do not use your private designs to train models for other customers. You are solely responsible for ensuring you have the necessary rights to any content you upload.
8. Third-Party Services
MarkupGen integrates with third-party services such as Figma and payment processors. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for their acts or omissions.
9. Termination
You may stop using MarkupGen and cancel your subscription at any time from your account settings. We may suspend or terminate your access if you violate these Terms or if required by law, with notice where reasonably possible.
10. Disclaimer of Warranties
MarkupGen is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that generated code will be error-free or fit for every use case.
11. Limitation of Liability
To the maximum extent permitted by law, MarkupGen and its team shall not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the service, even if advised of the possibility of such damages.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date above or through other reasonable means. Continued use of MarkupGen after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by applicable laws without regard to conflict-of-law principles, and any disputes shall be resolved through good-faith negotiation between the parties in the first instance.
